Terms of Service

These Terms of Service ("Terms") govern your use of the Pluck mobile application ("App") operated by Hjers Consulting AB ("we", "us", "our"). By using the App, you agree to these Terms.

1. Service Description

Pluck is a mobile application that uses artificial intelligence to extract recipes from URLs, images, videos, and social media posts into a personal recipe box. The App also provides an AI-powered cooking assistant to help you while cooking.

2. Eligibility

You must be at least 16 years old to use the App. By creating an account, you confirm that you meet this age requirement. If we learn that a user is under 16, we will terminate their account and delete their data.

3. Account Registration

• You may sign in using Google or Apple authentication
• You are responsible for maintaining the security of your account
• You must provide accurate information during registration
• You may not create multiple accounts for abusive purposes

4. Guest Mode

You may try the App as a guest with limited functionality: up to 3 recipe extractions per month and up to 10 stored recipes. Guest data is stored on our servers but is not associated with a permanent account. Creating an account is required for full access and to ensure your data is preserved long-term.

5. Subscriptions and Billing

5.1 Subscription Tiers

The App offers the following tiers:

Current pricing is displayed in the App. We may update pricing with reasonable notice.

5.2 Billing and Auto-Renewal

Subscriptions are billed through the Apple App Store or Google Play Store, depending on your device. Monthly and annual subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. A lifetime Pro option is also available as a one-time purchase.

5.3 Cancellation

You may cancel your subscription at any time through your device's app store settings (Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period - you retain access to premium features until then.

5.4 Refunds

Refunds are handled by Apple or Google in accordance with their respective refund policies. To request a refund, contact Apple App Store Support or Google Play Support directly. We do not process payments or refunds directly.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Submit content that infringes on third-party intellectual property rights
• Attempt to gain unauthorized access to our systems
• Use automated means to access the App beyond its intended use
• Abuse rate limits or attempt to circumvent usage restrictions
• Submit harmful, offensive, or inappropriate content to the AI assistant

7. Content Ownership

7.1 Your Content

You retain ownership of all recipes, images, and other content you create or upload to the App. By using the App, you grant us a limited license to process your content as necessary to provide the service (e.g., sending recipe text to AI providers for extraction or cooking assistance). This license is non-exclusive, revocable (by deleting your content or account), and limited solely to operating the service.

7.2 Extracted Recipes

Recipes extracted from third-party URLs and videos are sourced from publicly available content. We do not claim ownership of extracted recipe content. You are responsible for ensuring your use of extracted recipes complies with applicable copyright laws and the source's terms of use.

7.3 AI-Generated Content

Responses from the AI cooking assistant are generated by third-party AI models. While we strive for accuracy, AI-generated content may contain errors. You should use your own judgment when following AI cooking advice, especially regarding food safety, allergens, and dietary restrictions.

8. AI Processing

The App uses third-party AI providers (Anthropic, OpenAI, Google) to extract recipes and provide cooking assistance. By using these features, you acknowledge that:

• Recipe text, images, video frames, audio transcripts, and chat messages are sent to AI providers for processing
• No personal identifiers (email, user ID, etc.) are sent to AI providers
• AI providers do not use your data to train their models (per our agreements)
• AI extraction results may not be perfectly accurate - always review extracted recipes
• AI assistant responses are informational and not a substitute for professional advice

9. Video Processing

The App can extract recipes from video URLs (including TikTok, Instagram Reels, YouTube, and Facebook). Video processing works as follows:

• Video content is downloaded and processed on our servers to extract frames and audio
• Audio is transcribed using AI (OpenAI Whisper) to capture spoken recipe instructions
• Video processing is asynchronous and may take one to two minutes to complete
• You will receive a notification when the extracted recipe is ready
• Processed video data is not retained after extraction is complete

10. Usage Limits

In addition to the tier-based monthly limits in Section 5.1, the following rate limits apply to prevent abuse:

• Recipe extraction: 30 requests per hour
• AI assistant: 20 messages per minute
• Data export: 1 request per hour

We reserve the right to adjust these limits to maintain service quality.

11. Disclaimers

11.1 Service Availability

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be available at all times or free from errors.

11.2 AI Accuracy

AI-extracted recipes and cooking assistant responses may contain inaccuracies, including incorrect ingredient quantities, missing allergen information, or unsafe cooking instructions. Always verify recipe details and use your own judgment when cooking. We are not liable for any harm resulting from reliance on AI-generated content.

11.3 Third-Party Content

We are not responsible for the accuracy, legality, or quality of content from third-party websites or videos that you submit for recipe extraction.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, damages arising from:

• Inaccurate AI-extracted recipes or cooking advice
• Loss of data or recipes
• Service interruptions or downtime
• Unauthorized access to your account

Our total liability for any claim related to the App shall not exceed the amount you have paid us in the 12 months preceding the claim, or EUR 50, whichever is greater.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your personal data. The Privacy Policy forms part of these Terms.

14. Termination

• You may delete your account at any time from Settings > Privacy > Delete My Account
• We may suspend or terminate your access if you violate these Terms
• Upon account deletion, your personal data will be removed within 24 hours (except anonymised consent records retained for legal compliance)
• Active subscriptions are not automatically cancelled when you delete your account - cancel your subscription through your app store settings first to avoid further charges

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you may stop using the App and delete your account.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved by the courts of Sweden.

If you are a consumer in the EU/EEA, nothing in these Terms affects your statutory consumer rights under applicable local law, including your right to bring proceedings in your local courts.
